Terms of Use

These Terms of Use ("Terms") form a legal agreement between you and Trybe Streams Technology Limited ("Trybe", "we", "us" or "our") governing your access to and use of the Trybe mobile application and related services (the "Service"). By creating an account or using Trybe, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Trybe. If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. By using Trybe you represent that you meet these requirements and that the information you provide is accurate.

2. Your account

• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You agree to provide accurate information and to keep it up to date.
• Notify us immediately of any unauthorised use of your account.
• We may refuse, suspend or terminate accounts at our discretion, including for violations of these Terms.

3. The Service

Trybe is a social live-streaming platform that lets you broadcast live video, co-host with others, post reels and stories, send direct messages and voice notes, follow other users, and send or receive virtual gifts. We may add, change or remove features at any time.

4. User content

• Ownership: You retain ownership of the content you create and share ("User Content").
• Licence to us: You grant Trybe a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt, distribute, transmit and display your User Content solely to operate, promote and improve the Service. This licence ends when you delete your content or account, except for content already shared with others, content retained in backups for a limited period, or where retention is required by law.
• Responsibility: You are solely responsible for your User Content and the consequences of sharing it. You represent that you have all rights necessary to share it and that it does not infringe the rights of others.

5. Acceptable use

You agree not to use the Service to:

• Post or stream content that is illegal, hateful, harassing, defamatory, or that promotes violence or self-harm.
• Share sexual content involving minors, or any content that sexualises, endangers or exploits children. This is strictly prohibited and will be reported to the authorities.
• Share pornographic or sexually explicit content where prohibited, or non-consensual intimate imagery.
• Infringe intellectual property or other rights of others.
• Harass, bully, threaten, impersonate or invade the privacy of any person.
• Distribute spam, scams, malware, or attempt to hack, disrupt or reverse-engineer the Service.
• Collect or harvest other users' data without authorisation.
• Use the Service to violate any applicable law.

We may remove content and suspend or terminate accounts that violate these rules.

6. Live streaming and co-hosting

When you go live or co-host, your video and audio are transmitted in real time to viewers and co-hosts. Do not broadcast anything you would not want shared publicly. Co-hosts you invite or accept can be seen and heard by your audience. You are responsible for content broadcast during your streams.

7. Virtual coins and gifts

• Trybe may offer virtual coins and gifts that can be purchased and used within the app.
• Virtual coins have no monetary value, are not legal tender, and cannot be exchanged for cash except where expressly offered through an official creator payout programme and subject to its rules.
• Purchases are processed through Apple In-App Purchase and are generally non-refundable, except as required by law or Apple's policies.
• We may manage, regulate, modify or eliminate virtual coins and gifts at any time.
• Any creator payouts are subject to separate eligibility criteria, verification, applicable taxes and our payout terms.

8. Intellectual property

The Service, including its software, design, logos and trademarks, is owned by Trybe or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the app for personal, non-commercial purposes in line with these Terms. You may not copy, modify, distribute or create derivative works from the Service except as permitted.

9. Third-party services

The Service relies on third-party providers (including Amazon Web Services, Agora and Apple). Their services are governed by their own terms and privacy policies. We are not responsible for third-party services.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. On termination, your right to use the Service ends; sections that by their nature should survive (including content licences already granted, disclaimers, limitations of liability and dispute terms) will survive.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, secure or error-free, or that content shared by users is accurate or lawful.

12. Limitation of liability

To the maximum extent permitted by law, Trybe and its officers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or other intangible losses, arising from your use of (or inability to use) the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or ₦10,000.

13. Indemnity

You agree to indemnify and hold harmless Trybe from any claims, damages, liabilities and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or the rights of others.

14. Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law principles. You agree that the courts of Nigeria will have jurisdiction over any dispute arising from these Terms or the Service, subject to any non-waivable consumer rights you may have.

15. Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date and, for material changes, provide additional notice in the app. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
